1. Acceptance of Terms

By accessing or using AdCreator AI (https://adcreator-ai.com), operated by AdCreator AI ("we," "us," or "our"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, you may not use the Service.

We may update these Terms from time to time. Your continued use of the Service after any changes constitutes your acceptance of the revised Terms. We will notify registered users of material changes via email or in-app notice.

2. Account Registration and Responsibilities

To access certain features of the Service, you must create an account. You agree to:

• Provide accurate, current, and complete registration information (including your name and email address).
• Maintain the security and confidentiality of your login credentials.
• Accept responsibility for all activity that occurs under your account.
• Notify us immediately at admin@adcreator.ai if you suspect unauthorized access to your account.

You must be at least 18 years old or the legal age of majority in your jurisdiction to create an account.

3. Subscription Plans and Billing

3.1 Plans

AdCreator AI offers the following plans:

• Free: 5 ad generations at no cost. No payment information required.
• Starter: $79 per month.
• Pro: $149 per month.
• Agency: $299 per month.

3.2 Billing and Auto-Renewal

Paid subscriptions are billed monthly through PayPal. By subscribing, you authorize recurring monthly charges to your PayPal account. Subscriptions automatically renew at the end of each billing period unless cancelled before the renewal date.

3.3 Price Changes

We reserve the right to change subscription pricing. Existing subscribers will receive at least 30 days' notice before any price increase takes effect on their next renewal.

3.4 Free Tier Limitations

Free accounts are limited to 5 total ad generations. Once the limit is reached, a paid subscription is required to continue generating ads. Free accounts may have limited access to certain features or AI models.

4. Acceptable Use Policy

You agree not to use the Service to:

• Generate illegal, fraudulent, defamatory, or misleading advertising content.
• Create ads that promote hate speech, violence, discrimination, or illegal products and services.
• Scrape, crawl, or programmatically access the Service for competitive analysis or to build competing products.
• Abuse, overload, or interfere with the Service's API, servers, or infrastructure.
• Attempt to bypass usage limits, rate limits, or subscription restrictions.
• Share your account credentials with others or resell access to the Service without authorization.
• Upload or transmit malware, viruses, or any other harmful code.
• Violate any applicable law, regulation, or third-party rights.

We reserve the right to suspend or terminate accounts that violate this policy without notice or refund.

5. AI-Generated Content Disclaimer

AdCreator AI uses artificial intelligence, including services from Groq, Cerebras, DeepSeek, Mistral, Gemini, OpenAI, and Anthropic, to generate ad copy and creative suggestions. You acknowledge and agree that:

• AI-generated content is provided "as-is" with no guarantee of advertising performance, conversion rates, or return on ad spend.
• You are solely responsible for reviewing, editing, and approving all generated content before publishing.
• You are responsible for ensuring that all ads you publish comply with the advertising policies of the platforms where they are placed (e.g., Meta Ads, Google Ads, TikTok Ads).
• AI-generated content may occasionally produce inaccurate, incomplete, or inappropriate results. You must exercise your own judgment.
• We do not guarantee the originality of AI-generated content and are not liable for any intellectual property claims arising from your use of generated content.

6. Intellectual Property

6.1 Your Content

You retain ownership of the ad content generated through your use of the Service. You grant AdCreator AI a limited, non-exclusive license to store and process your content solely to provide the Service.

6.2 Our Platform

AdCreator AI retains all intellectual property rights in the platform, including but not limited to its software, design, algorithms, branding, and documentation. Nothing in these Terms grants you any rights to our intellectual property except as expressly stated.

6.3 Stock Photos

Generated ads may include stock photos sourced from Pexels. Your use of these images is subject to the Pexels License. You are responsible for complying with Pexels' terms, including attribution requirements where applicable.

7. Limitation of Liability

To the maximum extent permitted by law:

• AdCreator AI is provided "as is" and "as available" without warranties of any kind, express or implied.
• We do not warrant that the Service will be uninterrupted, error-free, or secure.
• In no event shall AdCreator AI, its owners, employees, or affiliates be liable for any indirect, incidental, special, consequential, or punitive damages, including loss of profits, revenue, data, or business opportunities.
• Our total aggregate liability for any claims arising from or related to the Service shall not exceed the amount you paid to us in the 3 months preceding the claim.

8. Termination and Account Deletion

You may cancel your subscription and delete your account at any time by contacting us at admin@adcreator.ai.

• Upon cancellation, your access to paid features continues until the end of the current billing period.
• Upon account deletion, we will delete your personal data and generated content within 30 days, except where retention is required by law.
• We reserve the right to terminate or suspend your account at any time for violation of these Terms.

10. Modifications to Terms

We may modify these Terms at any time by posting the updated version on this page. Material changes will be communicated to registered users via email at least 14 days before they take effect. Your continued use of the Service after changes become effective constitutes acceptance of the modified Terms.

11. Governing Law

These Terms shall be governed by and construed in accordance with applicable law. Any disputes arising from or related to these Terms or the Service shall be resolved through good-faith negotiation and, if necessary, binding arbitration.

12. Severability

If any provision of these Terms is found to be invalid or unenforceable, the remaining provisions shall continue in full force and effect.
